Elements of a DUI Charge

In Alabama, it is prohibited to drive or be in physical control of a vehicle when you have been drinking or using drugs. This includes any type of automobile or truck, and water vehicles such as jet skis or boats. Maneuvering any vehicle on highways, roads, or waters in the state while under the influence can result a DUI.

Other Criminal Offenses

Criminally negligent homicide is committed if a person kills someone while driving a vehicle under the influence. If the driver causes a person serious bodily injury while under the influence, they commit assault in the first degree.

Penalties for DUI Offenses

First Conviction

  • Jail sentence of less than one year
  • Fine of $600-$2,100
  • License suspension between 90 days and 6 months

Second conviction (within five years)

  • A mandatory jail sentence of at least 60 days (no more than one year)
  • A fine ranging from $1,100 to 5,100
  • A one-year license suspension

Third conviction

  • Jail sentence of at least 60 days (no more than one year)
  • A fine of $2,100 - $10,100
  • A three-year license suspension

In all convictions, a court referral evaluation is mandatory.
